Terms and Conditions

1. DETAILED DESCRIPTION OF GOODS AND/OR SERVICES
Minx Ceramics is a business in the Online Shop Service that supplies handmade pottery, to clients. All the pottery is designed and made by Michelle Luyt.

2. DELIVERY POLICY
Subject to availability and receipt of payment, requests will be processed within 7 -10 working days and delivery/self-collection confirmation will be sent via e-mail confirmation once the order is to be processed, along with the relevant waybill details if applicable. The items displayed on Minx Ceramics online shop are once-off-pieces and this stock is on hand at the dispatch premises. Minx Ceramics makes-per-order. If you have a specific order that has been received together with payment, the production process will then begin. Production time is anywhere from 4 – 12 weeks (possibly more) depending on the size of the order. Please allow for additional time to be allocated due to unforeseen load shedding interruptions.

4. OUR PRODUCTS
The products for sale on our website are intended for use within your personal capacity only.

We prohibit the purchase of any products for commercial resale purposes from our online retail shop. You may not use our products for any illegal and / or unauthorized purpose. We take all reasonable care to ensure that all details, descriptions and prices of products depicted on our website are as accurate as possible. It is possible for our website to contain certain errors, and we reserve the right to correct these errors at any stage. Should our error impact an order placed with us, we reserve the right to refuse or cancel this order in line with our order policy depicted below. Please note that the colours depicted in our designs may look slightly different across various computer monitors and screens. Receiving a product that differs slightly in colour, size, shape or pattern to what was depicted upon your screen when you placed your order does not warrant the good as faulty.

Please note that all Minx Ceramics items are unique, handmade, once-off pieces. Each piece is made, decorated and glazed by hand adding to its individual organic quality and character. Sizes, colour, shape and pattern may differ from piece to piece. All pieces when glazed are done so using lead free, food-safe glazes unless otherwise stated.

5. RETURNS AND EXCHANGES

In accordance with our returns policy depicted on our site, you may return a product and qualify for a full order refund based upon the following:

You make contact with us within 3 days of receiving your product. Product is not damaged and shows no sign of usage. Product is in original packaging and properly packaged. Shipping and handling charges are not refundable; including return shipment. We accept returns via our courier (The Courier Guy) at your cost.

We require full banking details in order to process the refund (not applicable to PayFast purchases) and we will do so within 7 – 10 working days of the goods reaching our door.
Please note that any product exchanges are treated as a new order and are thus subject to standard delivery times and costs.

If you receive a faulty / incorrect product from us, you qualify for a full order refund, or product replacement. Your replacement choice is subject to our stock availability. Kindly note that goods are only classified as faulty if they are received faulty in which case you need to supply us with a photograph of the faulty goods. Cracks classify as faulty. Items that are damaged during opening and from wear and usage are not considered faulty. Receiving a product that differs slightly in colour, size, shape or pattern to what was depicted upon your screen when you placed your order does not warrant the good as faulty.

Conditions of Return & Exchanges

  • Items may only be returned and exchanged if received damaged or defective.
  • Contact me within: 3 days of delivery
  • Ship items back within: 7 days of delivery
  • I don’t accept cancellations, but please contact me if you have any problems with your order.
  • Shipping costs are non-refundable. Buyers are responsible for all return shipping costs. If the item is not returned in its original condition, the buyer is responsible for any loss in value.

The following items cannot be returned or exchanged:

Because of the nature of these items, unless they arrive damaged or defective, I can’t exchange or accept returns for:

  • Custom or personalised orders
  • Items on sale

Please keep the following in mind when exchanging an item:

If we accept your request to have an item exchanged, the replacement item must be exchanged for one of the same kind. Your replacement choice is subject to availability. Please keep in mind that every piece made by Minx Ceramics is one of a kind and no designs are replicated. Therefore the replacement item will never be exactly the same the first one purchased. Products in the online shop are generally made ready. However if no similar item is in stock, a replacement will have to be made. Please allow for production time as I make per order. Production time is anywhere between 4 – 12 weeks (possibly more depending on the size of the order).

Refunds via PayFast:

In a case of a refund, the buyer must send Minx Ceramics the following information via email to info@minxceramics.co.za

  • First name & Surname name
  • E-mail address
  • The amount
  • The reason for the refund
  • Buyers banking details (branch holder, bank name, branch, branch code, account number, type of account & name of account).

6. YOUR ORDER
We reserve the right to refuse any order. This could, for example, result from one of the following:

The product being unavailable from stock, or identification of an error within the product information, such as pricing or promotion. Products in the online shop are generally ready-made. During the order process, and prior to shipment, you will receive an “order confirmation” email from us. This email does not guarantee that your selected product or products are available in stock and neither does it serve as a legally binding obligation to fulfil your order. Your order represents an offer to purchase, which we only accept when we dispatch your goods for shipment. We signify our acceptance of your offer through an email entitled “shipment concluded” (second email). We reserve the right to cancel your order anytime between receipt of order and shipment, for any reason, whether or not payment has been made. When payment has been made, you qualify for a full refund. In the unlikely event that your chosen product is not in stock and we cannot fulfil your order, we will contact you as soon as possible. In this case, you may qualify for a full refund to the buyer’s valid bank account.

Products are made to order. Please allow for production time from 4 – 12 weeks (possibly more, depending on the size of the order).

7. CUSTOMER PRIVACY POLICY

Minx Ceramics shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). Minx Ceramics is committed to safeguarding your privacy and ensuring that you continue to trust us with us with your personal information.

Customarily, we collect personal information only directly from you (contact data, payment, delivery details etc.). We will tell you what personal information is mandatory when placing an order.

In specific cases, personal information about you is collected by us automatically.

You may also provide personal information about others (for example when you place an order on other’s behalf). If so, you are responsible for the entire data you provide to use (and we assume that you are authorized to give such data).

We will collect your personal information only with specific purpose in mind (processing an order, sending you marketing communication etc.).

You must be 18 years or older to place an order with us.

In order to process your order, we will share your personal information with our partners.

You have specific rights in respect of data protection and we foster an environment facilitating their exercise (right to access, rectify, object, delete, receive your personal information or to complaint).

The private information we require from you in order to process your order include your personal information, delivery address and telephone numbers. These details will remain in strict confidence with us at all times. We will not sell or make your information known to any third parties. Only the information necessary for shipping will be provided to the courier service we use to deliver your product. We have taken all reasonable care to secure the credit card processing carried out when we receive payment for goods bought on our website. All Credit Card transactions take place via an internationally approved payment gateway, which uses the strictest form of encryption: Secure Socket Layer 3 (SSL3). No credit card details are made known to us, and no credit card details are stored on our website. Visit PayFast to see security certificate and privacy policy. We cannot be held responsible for any security breaches on your personal device, and the consequences of such breaches, which may result from a lack of adequate virus protection software or spyware.

All your options and messages will be responded as provided by law (delays in implementing you options may occur due to technical reasons).

8. PAYMENT OPTIONS ACCEPTED

Payment may be made via Visa, MasterCard, Masterpass, instant EFT, credit cards, American Express and Discover or by bank transfer into Minx Ceramics bank account, the details of which will be provided on request.

Production will only begin on your order once payment has been made and proof of payment supplied, and/or the payment reflects in our bank account.

South Africa & African Online Shoppers:

Payments may be made via credit card, debit card, MasterPass or by electronic bank transfers (EFT) into our bank account, the details of which will be provided on request. All details are provided upon checkout. All credit card transactions take place via Payfast; an internationally approved payment gateway. Please note that you do not have to have an existing Payfast account to pay via credit card – you can simply make use of the PayFast platform on a once off basis.

If you have elected to pay via EFT, payment must be made within 24 hours and proof of payment needs to be mailed to info@minxceramics.co.za. We reserve the right to cancel your order 24 hours after you have placed it should you not provide adequate proof of payment.

International Online Shoppers:

Please contact us directly should you wish to place an order. We accept payment via Visa and MasterCard through secure payment gateway Payfast. You do not need to have an account to make payment via Payfast.

9. CARD ACQUIRING AND SECURITY

Card transactions will be acquired for Minx Ceramics Online Store via PayFast (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. PayFast uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.payfast.co.za to view their security certificate and security policy.

10. CUSTOMER DETAILS SEPARATE FROM CARD DETAILS
Customer details will be stored by Minx Ceramics Online Store separately from card details which are entered by the client on PayFast’s secure site. For more detail on PayFast refer to www.payfast.co.za.

11. SHIPPING

We ship locally, nationally and internationally.

We ship during normal working hours Monday to Friday: not on Saturdays, Sundays and South African public holidays. We will supply all goods to our delivery company in good order.

South Africa Online Shoppers:

Delivery costs are a rate by weight fee. We courier to-door. Delivery times are normally within 2 – 3 working days. Deliveries to Regional Centers will take approx. 48 – 96 hours, depending on the situation (Please Note: 1-2 working days to be added onto transit times for Regional areas). Unless otherwise specified, your shipping cost shall be depicted upon checkout prior to payment and order processing. We can only ship to a full street delivery address and not to a PO Box number. Should no-one be present at the delivery address to sign receipt of delivery (third attempt) your goods will be returned to the shipping agent’s office, and it is your responsibility to collect them. We cannot be held liable for an incorrect shipping address entered into our system.

Once shipping fees are paid for by you, your order will then be shipped to you and your “shipment concluded”. Goods will only be released for shipment once final payment has been made and payment reflects in our bank account.

Once an order is shipped and the “sale concluded” the order is in the hands of courier service. Unfortunately, we cannot be held responsible for delays in delivery times caused by delays on the side of the courier.

All orders are tracked and you will be supplied with a waybill number.

Shipping costs are non refundable.

South Africa:

We use a local courier company and delivery options are available.

International Online Shoppers:

Minx Ceramics is not responsible for any international customs fees, duties or taxes incurred.

Minx Ceramics products are packaged with extra care in bubble wrap, with cardboard separators and newspaper filling, then placed together into boxes and labeled fragile.

International:

Our local courier uses a third party company and shipping options are available.

12. MERCHANT OUTLET COUNTRY AND TRANSACTION CURRENCY

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

13. RESPONSIBILITY
Minx Ceramics takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

14. COUNTRY OF DOMICILE
This website is governed by the laws of South Africa and Minx Ceramics chooses as its domiciliumcitandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, 20 Bird Street, Central, Port Elizabeth, 6001.

15. VARIATION
Minx Ceramics may, in its sole discretion, change this agreement or any part thereof at any time without notice.

16. ELECTRONIC COMMUNICATION
By using our website or communicating with us through electronic means (such as email) you consent and acknowledge that any and all communication we provide to you shall satisfy the legal requirement that such communication should be in writing.
